Des difficultés étant apparues dans le cadre de l'exécution des contrats de construction des usines, RUDIS et EMAC sont convenues par un protocole d'accord daté du 8 août 1989 de la désignation d'un expert-conciliateur, M. Pierre KARRER, qui a rendu un rapport daté du 17 mai 1991.

As difficulties had arisen in the performance of the plant construction contracts, RUDIS and EMAC agreed by a memorandum of understanding dated 8 August 1989 to appoint an expert conciliator, Mr Pierre KARRER, who submitted a report dated 17 May 1991.

Ensuite de nouveaux pourparlers, un nouveau protocole d'accord a été signé entre RUDIS et EMAC le 27 mai 1992, aux termes duquel EMAC s'est engagée à payer à RUDIS une somme de 11.700.000 dollars américains dans le cadre d'un accord financier entre les parties.

Following further discussions, a new Memorandum of Understanding was signed between RUDIS and EMAC on 27 May 1992, under which EMAC undertook to pay RUDIS an amount of 11,700,000 US Dollars as part of a financial agreement between the parties.

La dissolution de la société EMAC est intervenue en 2001.

EMAC was dissolved in 2001.

Faute d'avoir pu obtenir l'exécution du protocole, RUDIS a saisi le Tribunal de Sdi M'Hamed, département commercial, le 15 décembre 2007, d'une demande de payement de la somme de 11.700.000 dollars américains, plus intérêts moratoires et de réparation des préjudices subis.

As RUDIS was unable to obtain the execution of the memorandum, on 15 December 2007, it filed a claim with the Sdi M'Hamed Court, Commercial Department, for payment of 11,700,000 US Dollars plus default interest and compensation for the damages incurred.
