I. INTRODUCTION
For anyone within listening distance in recent years, the
international arbitration community has been abuzz with discussion
about concerns being expressed by corporate counsel. While the
frustration level in some quarters has led to company-wide bans on
arbitration clauses, elsewhere it has produced constructive dialogue
about improving the process to better suit the needs of users. This has
