In a forum of public discussion like this one, it is sometimes more interesting to engage controversy, to have strong disagreements which awaken the intellectual battlements and draw attention.  In my case this would be a difficult assignment, given the very thoughtful, and, in my view, largely correct analysis of the current state of the Swedish Arbitration Act, and indeed the international arbitration culture, in the context of confidentiality, protections of arbitrators and costs.  

I would hope, instead to offer, for a few moments, some observations from an institutional and personal point of view (I have spent nearly 30 years with American Arbitration Association and am in charge of the International Centre for Dispute Resolution of the AAA), much in the manner of sports announcers teamed up so that one remarks on the activity on the field of play and the other provides what we in the US call color commentary; broadening the perspective and background of the players and the sport, by way of stories and examples.
