The governing arbitration statute in Azerbaijan is the Law of the Republic of Azerbaijan On International Commercial Arbitration (the “Arbitration Law”), dated 1 November 18, 1999. Azerbaijan is also a party to the New York Convention, the Washington Convention and the European Convention.
Additionally, the Civil Procedure Code of the Republic of Azerbaijan (the “Civil Procedure Code”), effective 1 September 2001, contains provisions on the enforcement and recognition of foreign arbitral awards.
A.2 Types of Arbitration
Azerbaijani law distinguishes international arbitration from domestic arbitration and currently recognizes international arbitration only as a dispute resolution mechanism between foreign and Azerbaijani companies.
