Gunduz Karimov is a Partner in Baker & McKenzie’s Baku office specializing in dispute resolution, intellectual property and compliance matters. Mr. Karimov graduated from Baku State University and received his LL.M. from Indiana University in Bloomington. A member of the Azerbaijan Bar Association and a registered trademark attorney, Mr. Karimov is also vice-dean of the School of Law of Baku State University.

Jamil Alizade is an Associate in Baker & McKenzie’s Baku office. He graduated from Moscow State Institute of International Relations (MGIMO) and Maastricht University with degrees in intellectual property law and knowledge management. Mr. Alizade joined Baker & McKenzie in September 2011.

A. LEGISLATION, TRENDS AND TENDENCIES

A.1 General 

The governing arbitration statute in Azerbaijan is the Law of the Republic of Azerbaijan On International Commercial Arbitration (the “Arbitration Law”), dated 18 November 1999. Azerbaijan is also a party to the New York Convention, the Washington Convention and the European Convention.
 

Additionally, the Civil Procedure Code of the Republic of Azerbaijan (the “CPC”), effective 1 September 2001, contains provisions on the enforcement and recognition of foreign arbitral awards.
 

A.2 Types of Arbitration
 

Azerbaijani law distinguishes international arbitration from domestic arbitration and currently recognizes international arbitration only as a dispute resolution mechanism between foreign and Azerbaijani nationals or companies.
