According to the general principles of law, in order to discover whether an athlete has participated in any disloyal behaviour, the Sports Federation alleging the disloyal behaviour bears the burden of proof. The applicable standard of proof should be similar to that used in doping cases, given that the FILA regulations do not expressly provide for a specific standard of proof. Thus, given that, as in doping cases, the athlete is accused of a serious form of cheating, a similar standard of proof can be applied. Pursuant to the jurisprudence developed by CAS in doping cases, this standard must be established to the comfortable satisfaction of the Court having in mind the seriousness of allegation which is made.
