We write as the Director and Deputy Director of the American Law Institute (ALI), and as people who have had the pleasure of working closely with George Bermann on the Restatement of the Law, The U.S. Law of International Commercial and Investor-State Arbitration. We first want to give some background about how this project fits in with the ALI’s work, and then describe in more personal terms our experience working with George, who was Chief Reporter, and the team of Associate Reporters on the project.

The ALI was established in 1923 to promote the clarification and improvement of U.S. law, which at the time was dominated by state common law.  International law did appear to some extent in the Restatement First of Conflict of Laws, published in 1934, which was applicable to international as well as U.S. cases.
