I. PRESENT ATTITUDE TOWARD ENFORCEMENT OF FOREIGN MONEY JUDGMENTS
A. Describe the receptiveness of your government (including courts) toward enforcement of foreign money judgments.
There exists no negative approach of the Slovak Republic, whether by the Government or courts toward foreign money judgments, provided the conditions in the law or an international treaty which is biding for the Slovak Republic are satisfied. Upon access of the Slovak Republic to the EU on May 01, 2004, the number of the EU binding legal acts directly applicable for the Slovak Republic has been extended. Such acts include also the EU directives regulating mutual recognition of court decisions, particularly in civil and commercial matters. Thus, the Slovak Republic is liable to proceed in compliance with the EU standards, provided the judgment is given in an EU Member State. Otherwise, it is to be proceeded in accordance with international treaties which are binding for it or according to national regulations on the international private and procedural law, unless there exists an international, either bilateral or multilateral international treaty.
In the event the foreign judgment was given in any EU Member State, the following regulations apply for the procedure on recognition and enforcement of such judgments in civil and commercial cases:
1. COUNCIL REGULATION (EC) No. 1348/2000 of 29 May 2000 on the service of judicial and extrajudicial documents in civil or commercial matters,
2. COUNCIL REGULATION (EC) No. 44/2001 of 22 December 2000 concerning the judicial competence, the recognition and the execution of decisions in civil and commercial matters (hereinafter referred to as the “Council Regulation No. 44/2001”),
3. COUNCIL DIRECTIVE (EC) No. 8/2002 on improved access to justice in disputes extending state boundaries, by establishing minimum general rules applicable for legal assistance in such matters,
4. REGULATION (EC) No. 805/2004 of the European Parliament and of the Council of 21 April 2004 creating a European Enforcement Order for uncontested claims.
