INTRODUCTION 

International intellectual property (IP) disputes increasingly find their way into arbitration, both in commercial forums (such as ICC, WIPO, ICDR) and in investor–state arbitration (notably under ICSID and similar systems).  

A critical issue in these cases is the calculation of damages—the monetary relief awarded to a wronged IP owner. In deciding quantum, arbitration tribunals must navigate a complex interplay of legal standards drawn from diverse jurisdictions and international law to ensure that the claimant is made whole (or “fully reparated”) without overstepping the bounds of enforceability or public policy. In IP disputes, damages assessment can range from straightforward compensatory models (e.g. lost profits or reasonable royalties) to restitutionary measures (such as disgorgement of the infringer’s profits), each with its own legal acceptability and economic rationale.  

This essay provides an overview analysis of how damages are calculated in international IP arbitration, comparing common law and civil law approaches (with a primary emphasis on common law), examining practices in both commercial and investor–state arbitration, and surveys the influence of international treaties (like TRIPS and WIPO conventions) and national laws (e.g. the U.S. Lanham Act and Patent Act). The author also highlights recent developments in 2023–2024, including notable arbitral awards, evolving methodologies, and trends in damages awards.
