The March 10 unveiling of extensive arbitration research by the Consumer Financial Protection Bureau began a new era in the public policy fight over the use of arbitration in consumer disputes.

With the U.S. Supreme Court backing ADR in the cases it has decided involving individuals who challenged arbitration clauses in their sales and employment contracts, the Bureau—a 2010 Congressional creation by the Dodd-Frank Wall Street Reform and Consumer Protection Act—has set the stage to curtail business’s arbitration use.
