Attendu, selon l'arrêt attaqué, que la société Logistique Fret (la société Logfret), à laquelle avait été confiée l'organisation du transport, des Pays-Bas vers l'Australie, d'une machine, dont l'acheminement par voie maritime n'a pas été réalisé, a assigné, devant un tribunal de commerce, la société CP Ships France, aux droits de laquelle vient la société Hapag Lloyd (France), ainsi que la société CP Ships UK, en paiement d'une certaine somme, à titre de remboursement du prix de transport maritime et des frais du transport aérien de substitution ; que la société CP Ships UK a soulevé l'incompétence de la juridiction étatique en se prévalant de l'existence d'une clause compromissoire qui aurait été insérée dans ses conditions générales et rappelée au dos de ses connaissements ;

Whereas, according to the judgment under appeal, Logistique Fret (the company Logfret), which had been entrusted with arranging the transport from the Netherlands to Australia of a machine, the transport of which by sea was not carried out, brought an action before a commercial court against CP Ships France, the company from which Hapag Lloyd (France) derives, and CP Ships UK, in payment of a certain sum, as a reimbursement of the price of sea transport and alternative air transportation costs; that CP Ships UK alleged the lack of jurisdiction of the national court by claiming the existence of an arbitration clause which would have been inserted in its general conditions and recalled on the back of its bills of lading;
