I.  PRESENT ATTITUDE TOWARD ENFORCEMENT OF FOREIGN MONEY JUDGMENTS

A. Describe the receptiveness of your government (including courts) toward enforcement of foreign money judgments.

The enforcement of foreign judgments is an essential interest among the States to protect the rights and the obligations of the nationals and foreigners with interest within a jurisdiction, which may well be resolved in local or foreign courts. In the interests of safeguarding the rights and obligations already mentioned above and for maintaining the sovereignty and independence of the country of El Salvador, the principle of enforcing foreign money judgments has been established in the Constitution of the Republic, a legal norm of maximum importance, and regulated in secondary legislation. 

B. Briefly describe recent illustrative attempts, whether successful or unsuccessful, to enforce a foreign money judgment in your country, mainly concerning enforcement of any judgments from United States courts.

In El Salvador, the effectiveness in the enforcement of foreign money judgments depends solely on the compatibility of the judgment issued abroad with the local laws. That is to say; it may not contain any opinion contrary to local legislation. The defendant against whom the judgment is invoked had to be notified following the law by the foreign court and that the judgment is enforceable under such legislation.
