After Gilmer v. Interstate/Johnson Lane Court.1 the practice of requiring individual employees (not represented by unions) to agree in advance, and as a condition of employment, to the private arbitration of individual disputes arising from their employment has become increasingly widespread. Like many plainfiffs' counsel - and like the Equal Employement Opportunity Commission (EEOC) and the National Labor Relations Board (NLRB) - I view this trend with alarm.
