To many construction practitioners “international arbitration” is quite foreign, even though it has become increasingly common due to the expansion of the global marketplace. It is the most common form of dispute resolution in cross-border contracts. There are many reasons for this, including the ability to select a neutral forum and neutral arbitrators, the ability to avoid unfamiliar foreign courts and laws, and the ability to enforce arbitral awards in countries that are signatories to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
