Sur le moyen unique, pris en ses deux branches :

 

Attendu que la société française Omnium de traitement et de valorisation (OTV) a confié à la société anglaise Hilmarton Ltd une mission de conseil et de coordination pour l’obtention et l’exécution d’un marché de travaux en Algérie ; que la société Hilmarton a mis en oeuvre la clause compromissoire CCI du contrat pour avoir paiement du solde de ses honoraires ; que la sentence arbitrale rendue à Genève, le 19 août 1988, a rejeté cette demande ; que cette sentence a reçu l’exequatur en France tandis qu’elle était annulée en Suisse ;

On the two prongs of the sole argument:

 

Whereas the French company, Omnium de Traitement et de Valorisation (OTV) entrusted Hilmarton Ltd, an English company, with the task of providing advice and coordination for a bid to obtain and perform a contract for works in Algeria; Hilmarton relied on an ICC arbitration agreement contained in the contract in order to obtain payment for the remaining balance of its fees. The arbitral award, rendered in Geneva on 19 August 1988, dismissed this claim. This arbitral award was granted exequatur in France while being set aside in Switzerland;
