Vu l’article 1458 du nouveau Code de procédure civile ;

 

Attendu qu’il résulte de ce texte, applicable aux arbitrages internationaux, que, si les parties à un arbitrage peuvent s’adresser au juge étatique pour demander des mesures conservatoires destinées à garantir l’exécution de la sentence à venir, il ne leur est pas permis, avant cette sentence, de procéder à des mesures d’exécution ;

In light of Article 1458 of the New Code of Civil Procedure;

 

Whereas according to this text, applicable to international arbitration, although the parties involved in an arbitration may turn to a domestic court to request conservatory measures to ensure the enforcement of the award to be rendered, they may not, prior to the award, proceed with the enforcement measures;
