A.1 Legislation
In the last year, there has been no legislation that has advanced in
any significant way to amend or alter the Federal Arbitration Act
(FAA).
A.2 Trends and Tendencies
Since 2007, there have been efforts by a small minority in
Congress to amend the FAA to invalidate any pre-dispute
arbitration agreement that would require arbitration of any
employment, consumer, antitrust, or civil rights dispute. In May
2013, these attempts were revived by the reintroduction of the
proposed amendment in the House of Representative and in the
Senate. The bill failed to make it out of committee in either
chamber.
