There is no lis pendens within the meaning of Article 186(1bis) of the Swiss Private International Law Act if the proceedings before the national state courts and before the CAS do not have the same subject matter. What is more, even in the case of the same proceedings pending before the national State courts and the CAS, the CAS Panel has to have “considerable reasons” in order to suspend its proceedings.
