When the parties’ agreement expressly confers on the appeal panel “full” power to “review” the “facts” and the “law”, it reinforces the view that objectively, the parties intended a complete rehearing of their dispute. Any defect or procedural error even in violation of the principle of due process which may have occurred at first instance, whether within the sporting body or by the Ordinary Division CAS panel, will be cured by the arbitration proceedings before the CAS. The appeal panel is therefore not required to consider any such allegations. The CAS Code, if unaltered by the parties, is a constant no matter what the system of law the parties are familiar with and no matter what law the parties have agreed to be applicable to the merits of their dispute.
