APPENDIX B
Korean Commercial Arbitration Board Domestic Arbitration Rules
Effective as from September 1. 2011
CHAPTER I. GENERAL PROVISIONS
Article 1. Purpose
The purpose of these rules ("Rules") is for the Korean Commercial Arbitration Board ("KCAB") to provide for speedy and fair procedures for domestic arbitrations pursuant to the Arbitration Act.
Article 2. Definition
Domestic arbitration ("Arbitration") shall mean arbitrations between parties having their principal offices or permanent residences in the Republic of Korea, and not an International Arbitration as defined in the KCAB International Arbitration Rules.
Article 3. Scope of Application
In either of the following cases, the arbitration shall be conducted in accordance with these Rules, which shall be deemed to form a part of the arbitration agreement, subject to whatever modifications the parties may adopt in writing:
(a) where the parties have agreed in writing to refer their disputes to arbitration under these Rules; or
(b) where the parties have agreed in writing to refer their disputes to arbitration before the KCAB, and the arbitration is a domestic arbitration.
