I. PRESENT ATTITUDE TOWARD ENFORCEMENT OF FOREIGN MONEY JUDGMENTS
A. Describe the receptiveness of your government (including courts) toward enforcement of foreign money judgments.
In 1982, the Republic of Turkey (“Turkey”) passed the Law No. 2675 for International Private Law and Procedure (the “Law No. 2675”). Law No. 2675 was the first law to specifically address the recognition and the enforcement of foreign judgments in Turkey, which was substituted by the Law No. 5718 for the International Private Law and Procedure (the “Law No. 5718”).
Furthermore, Turkey has signed many reciprocity agreements on the recognition and the enforcement of foreign judgments respectively with:
(i) Italy (published in the Official Gazette dated March 3, 1929 and numbered 1133);
(ii) Austria (published in the Official Gazette dated September 23, 1991 and numbered 21000);
(iii) Romania (published in the Official Gazette dated February 10, 2008 and numbered 26783);
(iv) Egypt (published in the Official Gazette dated May 22, 2000 and numbered 24056);
(v) Republic of Georgia (published in the Official Gazette dated August 24, 1977 and numbered 23090);
(vi) Tunisia (published in the Official Gazette dated September 11, 1984 and numbered 18512);
(vii) Republic of Turkish Northern Cyprus (published in the Official Gazette dated February 13, 1989 and numbered 20079);
(viii) Poland (published in the Official Gazette dated July 23, 1990 and numbered 20583);
(ix) Austria (published in the Official Gazette dated September 23, 1991 and numbered 21000);
(x) Iraq (published in the Official Gazetted dated August 2, 1992 and numbered 21303);
