Private Arbitral Proceedings:
A Jurisdictional Survey

I. INTRODUCTION
The growth of multi-jurisdictional practice has been well
documented by scholars,1 and the use of private arbitration
proceedings in lieu of the courthouse is similarly on the rise.2 Yet
despite the emergence of these co-existing phenomena, there is
surprisingly little authority regarding whether an out-of-state
attorney’s3 representation of a party in a private arbitration
proceeding4 constitutes unauthorized practice of law (“UPL”).5
