One of the important means of protecting contractual rights is through the treteiski sud (commercial arbitration court) elected by the parties (hereinafter commercial arbitration). This body of protection is directly mentioned in point 1 article 9 of the Civil Code of the Republic of Kazakhstan (hereinafter referred to as CC).

Arbitration is widely practiced all over the world. There are international conventions regulating such procedure which has been acceded to by the Republic of Kazakhstan. Such regulation implies that an arbitral award can be submitted by the winning party for enforcement to the state court in the country of the party in breach.
