I. Introduction

1. The Tribunal's determination of the facts will be dispositive of the Respondent's jurisdictional objections. The Respondent has alleged that the Claimants' claims (a) result from measures that occurred befroe the entry into force of the CAFTA on 1 January 2009 and (b) are out of time because the Claimants allegedly knew or should have known of the breaches (and had suffered a loss) on or before 10 June 2010, being the date three years befroe the filing of their claims.
