“It is well-recognized that the availability of prompt, effective and economical means of dispute resolution is an important element in the orderly growth and encouragement of international investment and trade.” This statement kicks off the recently formulated arbitration and mediation rules of the Commercial Arbitration and Mediation Center for the Americas (CAMCA), applicable to disputes arising in the sphere of the North American Free Trade Agreement. CAMCA procedures may be of even greater value as a template for the resolution of commercial disputes between disputants of countries other than Canada, Mexico and the U.S., says author Walter Gans. His article, which was presented at a CAMCA briefing on Oct. 3, 1996 in New York City, explores the exceptional value of informal processes such as mediation.
