This is an application for judicial review in respect of:

1. The denial of benefits under Chapter 11 of the North American Free Trade Agreement (“NAFTA”) to the Applicant by the Trade Law Bureau, on behalf of the Department of Foreign Affairs and Trade Canada ("DFAIT"), purportedly pursuant to Article 1113(2) of the NAFTA, which denial of benefits was communicated to the Applicant by letter dated March l, 2012 (the "Decision").
