Whether an arbitrator is viewed as an adjudicator or a service provider, his or her role in the dispute resolution process is one of significant power.  I want to discuss the kinds of power an arbitrator possesses, the sources of that power, and the sufficiency of that power. Because arbitration has expanded its universe and is dealing both with larger and more complex issues and with a greater diversity of participants, questions arise as to whether arbitrators have enough power to function effectively.  Can or should their power be expanded to deal with more modern demands on the process of arbitration?
