LABOR -- MOTION TO STAY ARBITRATION -- AAA NOT A NECESSARY PARTY TO LITIGATION -- LABOR RULES 42

The AAA is not a necessary party to a related litigation. The faculty association demanded arbitration under its contract with the district. The District moved pursuant to CPLR 7508 to slay the arbitration but did not name the AAA as a party to the action and did not obtain a preliminary stay of arbitration pending the outcome of the motion.
