Enclosed please find the Republic of Guatemala's ("the Republic") request pursuant to Article 10.20(5) of the Dominican Republic - Central America - United States Free Trade Agreement ("CAFTA-DR"). The request respectfully asks the Tribunal to consider on an expedited basis an objection by the Republic to the Tribunal's competence and/or its ability to further consider the merits of the dispute brought by Railroad Development Corporation ("Claimant") in the above-captioned matter given Claimant's failure to comply with the requirements of Article IO.l8(2)(b) of CAFTA-DR
