I. THE PARTIES’ REQUESTS AND PROPOSALS

1. The present Procedural Order addresses the manner in which the Respondent’s preliminary objections will be heard—in a preliminary phase of the proceedings or joined to the merits— and sets out the timetable for the arbitration.

2. The Respondent requests that the Tribunal exercise its discretion under Articles 17 and 23(3) of the UNCITRAL Rules to order that its objections be heard in a preliminary phase of the proceedings.1

3. The Claimant requests that the Tribunal refuse to order bifurcation of the proceedings.2

4. In accordance with their respective requests, the Parties have proposed indicative timetables for the subsequent procedural stages of the dispute depending on whether the Tribunal orders a bifurcated or non-bifurcated procedure.3
