Regarding International Commercial Arbitration
Given that the Honorable National Congress has approved the following:
Bill of Law:
CHAPTER 1
GENERAL PROVISIONS
Article 1: Scope of Application
1. This law shall apply to international commercial arbitration, without prejudice to any international or bilateral treaty in effect in Chile.
2. The provisions of this law, with the exception of Articles 8, 9, 35, and 36, shall apply only if the place of arbitration is located within the territory of Chile.
3. Arbitration is “international” where:
a. The parties to an arbitration agreement have, at the time of the making of the contract, their place of business in different states, or
b. One of the following is situated outside of the state where the parties have their place of business:
i. The place of arbitration, if it has been determined in the arbitration agreement or by amendment of the arbitration agreement by the parties, or
