Good Faith Defense Fails
Respondent incorporated Gay All Our Lives, Inc., in the State of
Florida in February of 2002 as an organization dedicated to address
critical issues facing the gay community. Respondent registered the
gayaol.com domain name as an acronym of his organization to operate as
a platform for education and community service. Complainant claimed
that the gayaol.com domain name infringed on Complainant’s AOL mark
and resolved to a pornographic website. Despite Respondent's assertions
of good faith and legitimate use, the Panel found that the domain name
infringed upon Complainant’s rights in the AOL mark and ordered
Respondent to transfer the domain name to Complainant. Am. Online, Inc.
