L'Arbitrage (droit interne, droit international privé) ("L'Arbitrage") is the sixth edition of a noted French text on French arbitration law by Jean Robert, a preeminent contributor in the field of arbitration, particularly in the international area. Maître Robert, a Doctor of Law, graduate of the prestigious French business school Hautes Etudes Commerciales and a member of the Paris bar, was one of the principal draftspersons of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Through his writing (including the publication in 1983 of The French Law of Arbitration, written together with Thomas Carbonneau, a Professor of Law at Tulane), the French arbitration law has become well known outside France. He was also Vice President of the ICC's Court of Arbitration, as well as the President of the Committee on Procedure of the International Bar Association.
The sixth edition of the work was concluded just before Maître Robert's death in 1993 and ten years after the publication of his fifth edition. The timing of both of these editions is significant in terms of the development of French arbitration law.
Prior to 1980, France had not substantially revised its arbitration law since the first Code of Civil Procedure of 1806. However, these rules became outdated, particularly as international arbitration became more prevalent. As a result, an extensive body of case law was developed by the French courts, at times with inconsistent results and excessively complex solutions.
