As in a number of other jurisdictions, arbitration in Portugal has significantly increased over the last decade or so. Arbitration is now regularly used to resolve commercial disputes. Due to the significant caseload of the state courts, arbitration is considered by parties to be an advantageous and streamlined alternative dispute resolution mechanism. In practice this has led to a concerted effort by private parties and the Portuguese Government to develop ADR procedures and practice.
