The Presidium of the Supreme Commercial Court of the Russian Federation has reviewed the Overview of Commercial Court Practice in Cases Where the Public Policy Exception Has Been Applied as a Ground for Denying Recognition and Enforcement of Foreign Judgments and Awards and, in accordance with article 16 of the Federal Constitutional Law “On the Commercial Courts in the Russian Federation,” hereby informs the commercial courts of the recommendations that have been developed.

A commercial court’s consideration of the consequences of enforcing a foreign judgment or award with regard to the issue of violation of the public policy of the Russian Federation must not lead to review of the judgment/award on the merits.
