I. INTRODUCTION
A. Arbitration in Consumer and Employment Contracts Supported by
the United States Supreme Court
In one commentator’s words, the United States Supreme Court “has
created a monster” in its fervent support of arbitration as an alternative
dispute resolution mechanism.1 Specifically, that monster is the Court’s
support for pre-dispute arbitration clauses in adhesionary contracts
between individual consumers and financial institutions, as well as
between employees and their employers.2
