ACT III – HEARING ON QUANTUM
SCENE II – THE HEARING ON QUANTUM (PART 2)
Claudia T. Salomon, Workshop Co-Chair
Well, on to Scene II of this hearing. We now are going to hear
from Paragonia’s expert. We will have the direct examination by
Pierre Karrer. Paragonia’s expert will be played by Brent Kaczmarek
and United’s lawyer, who will do the cross-examination, will be
played by Mark Levy of Allen & Overy. Our Tribunal will remain the
same. It is for you, again, to decide if the different tactics used by
counsel are more effective than those used in Scene I.
SALLY HARPOLE: Before we proceed, we want to remind all of
you that we will not tolerate the proceedings being treated as if we
were in an American court, and above all, we expect a very civilized
manner throughout this hearing. With that warning, Mr. Karrer, are
you prepared to begin your direct examination of the witness?
PIERRE KARRER: I am.
SALLY HARPOLE: Please begin.
PIERRE KARRER: Thank you. Good afternoon, sir.
BRENT KACZMAREK: Good afternoon.
PIERRE KARRER: Would you please state your name for the
record?
BRENT KACZMAREK: Brent Kaczmarek.
PIERRE KARRER: Thank you. And you are the quantum expert on
behalf of the Respondent, the Republic of Paragonia, correct?
BRENT KACZMAREK: That is correct.
PIERRE KARRER: So can you please tell the members of the
Arbitral Panel about some of your credentials?
