On 24 October 2008, GEA filed a Request for Arbitration (the “Request” or “RfA”) against Ukraine with the Acting Secretary-General of the International Centre for Settlement of Investment Disputes (“ICSID” or the “Centre”). The Request was filed pursuant to Article 13(2) of the Agreement between the Federal Republic of Germany and Ukraine on the Promotion and Mutual Protection of Investments, dated 15 February 1993 (the “BIT”) and pursuant to the Convention on the Settlement of Investment Disputes between States and Nationals of Other States, dated 14 October 1966 (the “ICSID Convention”).
