“Arbitration is as good as the arbitrators are” is what we often say or hear. After – or during – each case, we all tend to either praise or complain about the arbitrators. A common grievance, in particular as part of our relentless discussions on time and cost efficiency in international arbitration, relates to the “hands off” or “detached” arbitrator or “over-cautious” arbitrator, as opposed to the “proactive” or “engaged” or “firm” arbitrator. The “proactive” arbitrator is usually depicted as the “dream arbitrator” at conferences and in publications.
