The present dispute is submitted to arbitration under the Agreement between the Kingdom of the Netherlands and the Republic of Poland on Encouragement and Reciprocal Protection of Investments of 7 September 1992 (the “Dutch–Polish BIT”, the “BIT” or the “Treaty”).
