Although the importance of publishing arbitration awards is well established, there are varying opinions as to the proper method to obtain the consent of the parties. The National Academy of Arbitrators, in its Code of Professional Responsibility, states that arbitrators should normally not request permission to publish until after the award has been issued.
A survey was conducted to determine whether participants in the arbitration process would object to a pre-award request from the arbitrator for permission to publish the decision. The authors conclude that most parties would not be opposed to pre-award publication inquiries and do not believe that this would have a negative impact on the process.
