LA COUR DE CASSATION, PREMIÈRE CHAMBRE CIVILE, a rendu l’arrêt suivant:

THE COUR DE CASSATION, FIRST CIVIL CHAMBER, has rendered the following decision:

Attendu que le 17 décembre 2001, la société Chantiers de l’Atlantique (CAT) a conclu avec la société Gaz transport et tecnigaz (GTT) un contrat de licence de technologie pour la construction de trois navires méthaniers, la société GTT apportant sa technologie d’isolation des cuves; que des difficultés techniques étant survenues, la société CAT a engagé une procédure d’arbitrage à l’encontre de la société GTT; que par sentence finale rendue à Londres, le 3 février 2009, le tribunal arbitral a notamment déclaré non fondées les demandes de la société CAT, condamné celle-ci à payer certaines sommes à la société GTT et ordonné l’exécution provisoire de la sentence; que la société CAT a relevé appel de l’ordonnance revêtue de l’exequatur;

Whereas on 17 December 2001, Chantiers de l’Atlantique (CAT) entered into a technology license contract with Gaztransport et technigaz (GTT) for the construction of three LNG tankers, GTT contributing its technology for insulation of the containers; that technical difficulties having arisen, CAT commenced arbitration against GTT; that by final award rendered in London  on 3 February 2009, the arbitration tribunal dismissed CAT’s claims, ordered it to pay certain amounts to GTT and ordered the provisional enforcement of the award; that CAT appealed the enforcement order;
