LA COUR DE CASSATION, PREMIÈRE CHAMBRE CIVILE, a rendu l’arrêt suivant:

THE COUR DE CASSATION, FIRST CIVIL CHAMBER, has rendered the following decision:

Attendu que, pour l’organisation des jeux méditerranéens, le Président de la République arabe de Syrie a institué un comité d’organisation; que ce comité, dépourvu de la personnalité morale, a constitué un comité de publicité placé sous la présidence du directeur de l’Organisation arabe de publicité (Golan); qu’à la suite d’un appel d’offres, Golan a signé, le 22 mars 1986, avec la société panaméenne Papillon group corporation (PGC) un contrat cadre comportant une convention d’arbitrage, suivi de plusieurs autres contrats; qu’à la suite d’un premier différend, un tribunal arbitral a condamné solidairement Golan et la République arabe de Syrie à payer des dommages-intérêts à la société PGC; que la société PGC a de nouveau saisi un tribunal arbitral d’une demande de condamnation notamment de Golan et de la République arabe de Syrie; que, par sentence du 11 octobre 2007, l’un des arbitres ayant rédigé une opinion dissidente, le tribunal arbitral s’est en particulier déclaré incompétent à l’égard de la République arabe de Syrie et a déclaré une partie des demandes prescrites; que la société PGC a formé un recours en annulation contre cette sentence;

Whereas, for the organization of the Mediterranean Games, the President of the Arab Republic of Syria established an organizing committee; that this committee, which is devoid of legal personality, has set up an ad-hoc committee under the Presidency of the Director of the Organisation arabe de publicité (Golan); that following a public request for tender, Golan signed, on 22 March 1986, with the Panamanian company Papillon group corporation (PGC) a framework contract comprising an arbitration agreement, followed by several other contracts; that following an initial dispute, an arbitral tribunal had jointly condemned Golan and the Syrian Arab Republic to pay damages to PGC; that PGC has again petitioned an arbitral tribunal asking that it find in particular against Golan and the Arab Republic of Syria; that, by an award of 11 October 2007, one of the arbitrators having submitted a dissenting opinion, the arbitral tribunal declared that it did not have jurisdiction against the Arab Republic of Syria and declared some of the requests time barred; that PGC has brought an action for annulment of this award;
