Attendu, selon l'arrêt attaqué, que M. X..., titulaire de la charge d'huissier de justice de Moorea, a présenté sa démission acceptée par arrêté du conseil des ministres du territoire du 6 mai 2003 ; que M. X...et Mme Y... épouse Z... ont, le 24 octobre 2003, conclu un protocole d'accord comportant une clause d'arbitrage, afin d'organiser la transition résultant de la démission du premier et de la nomination à la charge de la seconde, sous la condition suspensive de la nomination effective de celle-ci, M. X...s'engageant notamment à lui présenter l'ensemble de sa clientèle et lui fournir son fichier de clients, et en contrepartie Mme Y... épouse Z... s'engageant à lui verser une certaine somme ; que Mme Y... épouse Z..., nommée par arrêté du 21 novembre 2003, a réglé la somme correspondant à la présentation du fichier des clients ; que Mme Y... épouse Z... a assigné M. X...en remboursement de cette somme ;

Considering that, according to the contested judgment, Mr. X..., bailiff of Moorea, submitted his resignation, which was accepted by order of the Council of Ministers of the Territory of 6 May 2003; that Mr. X... and Mrs. Y.... wife Z... concluded, on 24 October 2003, a memorandum of understanding containing an arbitration clause, in order to organise the transition resulting from the resignation of the former and the appointment of the latter, under the condition precedent of the latter's effective appointment, Mr. X...undertaking in particular to present all his customers to him and to provide him with his customer file, and in return Mrs Y..., married name Z...., undertaking to pay him a certain sum; that Mrs Y... married name Z..., appointed by order of 21 November 2003, paid the sum corresponding to the presentation of the customer file; that Mrs Y... wife Z.... has brought a claim against Mr X.... for reimbursement of this sum;
