LA COUR DE CASSATION, CHAMBRE COMMERCIALE, a rendu l’arrêt suivant:

THE COUR DE CASSATION, COMMERCIAL, FINANCIAL AND ECONOMIC CHAMBER, has rendered the following decision:

Attendu, selon l’arrêt attaqué, que la société de droit allemand Wedi GmbH (la société Wedi) a conclu avec M. X... un contrat d’agent commercial le 23 novembre 1993 en vue de la prospection de sa clientèle française; qu’à la suite de la réduction du secteur d’activité qui lui avait été confié, M. Sick a assigné la société Wedi, ainsi que sa filiale française, devant le tribunal de commerce, pour réclamer, en application de la loi française, certaines sommes, notamment à titre d’indemnité de cessation de contrat, indemnité de préavis et en complément du droit de suite;

Whereas, according to the judgment under appeal, the German law company Wedi GmbH (Wedi) entered into a commercial agency contract with Mr Sick on 23 November 1993 with a view to prospecting its French clientele; that as a result of the shrinkage of the business line entrusted to him, Mr. Sick summoned Wedi, along with its French subsidiary, before the commercial court, to claim for certain amounts, in accordance with French law, in particular as compensation for termination of employment, compensation for lack of advance notice and the droit de suite;
