Claimants' Response rests entirely on the untenable premise that, in spite of the title of CAFTA Article 10.18, "Conditions and Limitations on Consent of Each Party," the waiver requirement in CAFTA Article 10.18 is not a condition precedent to consent. This flawed premise is the foundation for Claimants' other arguments. Because this unsound foundation cannot stand, all the arguments based on it fall.
