On May 22, 2004, the Council of the International Bar Association approved the long awaited “IBA Guidelines on Conflicts of Interest in International Arbitration” (the “Guidelines”).   Drafted by a Working Group made up of 19 legal practitioners originating from 14 countries, the Guidelines aim to foster a more consistent approach to the complex issues of disqualification and challenge of arbitrators.  Although the Guidelines are not legally binding, the Working Group expressed the hope that they will achieve the same success as the IBA Rules on the Taking of Evidence in International Commercial Arbitration, which have become a widely used reference for practitioners.
