UNCITRAL’S ACHIEVEMENTS
38.1. UNCITRAL’S Achievements in the Field of
Arbitration
The United Nations has long played a very important role in the field of arbitration.
The New York (1958) Convention
The United Nations’ main achievement in this field was the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, which was entered into in New York1 at the United Nations Conference on International Commercial Arbitration.2 This Convention has since become the cornerstone of international arbitration.
UNCITRAL
In 1966 the United Nations resolved to create a Commission on International Trade Law (“UNCITRAL”).
Sixty states have become members of that commission. The commission is the arm of the United Nations in this area.
The UNCITRAL Arbitration Rules
In 1976, after a lengthy period of preparation and broad debate UNCITRAL completed a set of arbitration rules: the UNCITRAL Arbitration Rules,3 which have been welcomed by parties from developing and developed countries as a useful tool when deciding whether to refer a dispute to ad hoc arbitration. The Rules were amended in 2010.
