CONCILIATION
—The Perspective of China Conciliation in the 21st Century

I. Brief Introduction to the Institutions
The China Council for the Promotion of International Trade
(CCPIT)/ China Chamber of International Commerce (CCOIC)
Conciliation Center (hereinafter referred to as CCPIT/CCOIC Conciliation
Center), formerly called Beijing Conciliation Center of China Council for
the Promotion of International Trade (CCPIT)/China Chamber of
International Commerce (CCOIC), was established in Beijing in 1987. As
the response to the needs of China’s ongoing reform and opening-up as
well as the development of conciliation business, CCPIT/CCOIC has since
1992 set up 40 municipal conciliation centers within its Sub-Councils in
various provinces, municipalities, and major cities in the Mainland China.
The CCPIT/CCOIC Conciliation Center and its Sub-Council conciliation
centers have covered almost all the main areas in the Mainland China, and
a conciliation network all over the country has, therefore, been
established.
CCPIT/CCOIC Sub-Council conciliation centers report to
CCPIT/CCOIC Conciliation Center in business, and CCPIT/CCOIC
Conciliation Rules, which are formulated by the CCPIT/CCOIC
Conciliation Center, are uniformly applied to CCPIT/CCOIC Conciliation
Center and its Sub-Council conciliation centers.
As the permanent conciliation institutions in China, the
CCPIT/CCOIC Conciliation Center and its Sub-Council conciliation
centers, by the means of conciliation or mediation, independently and
impartially assist disputants to settle their disputes arising from
commercial, maritime and other business. The conciliation centers accept
cases in accordance with the conciliation agreement reached between the
parties, or—in the absence of such agreement—in accordance with one
party's application for conciliation with the consent of the other party. The
CCPIT/CCOIC Conciliation Center and its Sub-Council conciliation
centers maintain, respectively, a Panel of Conciliators for the parties to
choose in their specific cases. The conciliators on the Panels are selected
and appointed respectively by CCPIT / CCOIC and its Sub-Councils from
among the just and upright personages with professional knowledge
and/or practical experience in the field of commercial and maritime
business and /or law.
