I. OVERVIEW
The dispute arose over the termination of Roderick Campbell’s
employment at General Dynamics Government Systems Corporation
(General Dynamics).1 Suffering from sleep apnea, Campbell was
sometimes unable to wake up in the morning and prone to fall asleep
during the work day.2 When General Dynamics terminated his
employment, Campbell filed suit, alleging disability discrimination in
violation of the American With Disabilities Act (ADA).3 In response,
General Dynamics moved to stay the proceedings and to compel
arbitration pursuant to the company’s Dispute Resolution Policy (DRP),
which required Campbell to submit his discrimination claims to
mandatory arbitration.4 Campbell questioned the enforceability of the
